2. Description of Service
Abatta Care provides care services including but not limited to transportation, home visits, meal services, and personal care. We facilitate the discovery, booking, and payment for these care services.
3. User Accounts
Registration
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Client Terms
As a client using our Platform, you agree to:
- Provide accurate information about care needs
- Pay for booked services according to agreed terms
- Treat caregivers with respect and professionalism
- Provide safe conditions for in-home services
- Give reasonable notice for cancellations
5. Bookings and Payments
Booking Process
Bookings made through the Platform constitute a service agreement. Please review all details before confirming a booking.
Payments
All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service.
Cancellations
Please provide at least 24 hours notice for cancellations. Cancellation terms may vary by service.
6. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Post false, misleading, or defamatory content
- Harass, abuse, or harm other users or staff
- Scrape or harvest data from the Platform
- Interfere with the Platform's operation
7. Intellectual Property
The Platform and its content, features, and functionality are owned byAbatta Care and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
8. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WHILE WE STRIVE TO PROVIDE THE HIGHEST QUALITY CARE, USERS SHOULD VERIFY SERVICE DETAILS BEFORE BOOKING.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABATTA CARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
10. Indemnification
You agree to indemnify and hold harmless Abatta Care from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.
11. Dispute Resolution
Any disputes arising from these terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12. Modifications
We reserve the right to modify these terms at any time. We will notify users of material changes. Continued use of the Platform after changes constitutes acceptance of the modified terms.
13. Termination
We may terminate or suspend your account at any time for violation of these terms. You may close your account at any time through your account settings.
14. Governing Law
These terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.
